These Terms of Service ("Terms") govern your access to and use of bestyshape.com (the "Site") and any purchase you make from BestyShape ("we", "us", "our"). By accessing the Site or placing an order, you agree to these Terms. If you do not agree, do not use the Site.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to purchase from us.

2. Account and information

You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for activity under your account.

3. Products, descriptions, and colors

We try to display our products and their colors accurately, but we do not warrant that descriptions, images, sizing, or colors are exact or error-free, as displays vary. Garment fit and results vary by individual.

4. No medical or health claims

Our products are apparel intended for everyday wear and styling. They are not medical devices and are not intended to diagnose, treat, cure, or prevent any condition, nor to cause weight loss or permanent body change. Any statements about appearance, shaping, or comfort are not guarantees of specific results. Consult a healthcare professional before use if you have a medical condition.

5. Pricing and errors

All prices are in the currency shown at checkout and may change at any time. In the event of a pricing or product description error, we reserve the right to cancel or refuse any order placed at the incorrect price, even after an order confirmation, and to refund any amount charged. Promotional comparison prices, where shown, reflect a former or reference price, and the price you pay is the price displayed at checkout.

6. Orders and acceptance

Your order is an offer to buy. We may accept or decline any order, including for suspected fraud, resale, or errors. No contract exists until we confirm shipment.

7. Intellectual property

All content on the Site, including text, graphics, logos, and images that we own or license, is protected by intellectual property laws and may not be copied or used without our written permission. The "BestyShape" name and branding are our property.

8. User content

If you submit reviews, photos, or other content, you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, display, and reproduce it in connection with our business. You represent that you own or have the rights to the content and that it is truthful and lawful. We may remove any user content at our discretion. Copyright complaints are handled under the procedure in our Legal Notice.

9. Prohibited uses

You agree not to use the Site for any unlawful purpose, to infringe others' rights, to introduce malicious code, to scrape or copy the Site, or to interfere with its operation.

10. Disclaimer of warranties

THE SITE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THESE MAY NOT APPLY TO YOU.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BESTYSHAPE AND ITS OWNERS, OFFICERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA, ARISING FROM YOUR USE OF THE SITE OR ANY PRODUCT. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless BestyShape and its owners and agents from any claims, losses, and expenses, including reasonable attorneys' fees, arising from your breach of these Terms or your misuse of the Site.

13. Payment disputes

You agree to contact us before initiating any chargeback and to give us a reasonable chance to resolve the issue, as described in our Return & Refund Policy. We reserve the right to dispute wrongful chargebacks with supporting evidence.

14. Binding arbitration and class action waiver

PLEASE READ THIS SECTION CAREFULLY, AS IT AFFECTS YOUR LEGAL RIGHTS. Any dispute arising out of or relating to these Terms or any purchase will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring a claim in small claims court. The arbitration will be conducted on an individual basis only. YOU AND WE WAIVE ANY RIGHT TO A JURY TRIAL AND ANY RIGHT TO PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. Opt-out: you may opt out of this arbitration agreement by sending written notice to Bestyshape@proton.me within 30 days of your first purchase, stating your name, order number, and intent to opt out. If any part of this section is found unenforceable, the remainder will continue to apply, except that the class action waiver is not severable, and if it is found unenforceable this entire arbitration section will not apply.

15. Governing law

These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law rules, except where mandatory consumer protection laws of your state or country apply.

16. Force majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including carrier delays, supply disruptions, natural events, or government action.

17. Changes and severability

We may update these Terms at any time, and the updated version applies to orders placed after it is posted. If any provision is found invalid, the rest remains in effect.

18. Entire agreement

These Terms, together with our Privacy Policy, Return & Refund Policy, and Shipping Policy, are the entire agreement between you and us regarding the Site.
